The Delhi High Court clarifies the duties of litigants and lawyers in court cases, emphasizing the importance of diligence and responsibility.
The court has said that it’s the duty of litigants to diligently pursue their case and not solely rely on their lawyers. In a recent case, the court was not convinced by the litigant’s claim that his lawyer alleged negligence in the case was the ground for delay. According to the litigant, his lawyer was negligent in pursuing the case- which pertained to the matter of eligibility of the litigant to government post.
The court rejected the excuse given by the litigant, that he engaged to file a challenge in High Court, and he interacted with lawyer over phone several times, but his lawyer gave false information. But in August 2024 he found out that his case was never filed in HC.
